Draft Study: Regulatory Impact Assessment of the Proposed Amendments to the Air Protection By-Law No. (28) of 2005

The study highlights increasing challenges to air quality in Jordan stemming from population growth, industrial expansion, and refugee influxes. This stands in contrast to the weak compliance of industrial facilities in installing Continuous Emission Monitoring Systems (CEMS). Currently, the rate of direct electronic data linkage to the central monitoring system does not exceed 8.1% of targeted facilities. This discrepancy may lead to exceedances of key pollutant concentrations—such as PM₂.₅, PM₁₀, SO₂, and NOx—with potentially severe public health, economic, and environmental consequences. The core issue is the absence of clear, legally binding obligations mandating industrial facilities to link directly to the central monitoring system operated by the Ministry of Environment. The study has identified an urgent need to increase the number of linked facilities from the current 12 to 148 by 2033. The study evaluates three regulatory alternatives: Maintaining the Status Quo: Likely to negatively impact the environment and public health, while exacerbating economic burdens. Administrative and Technical Adjustments Without Legislative Amendment: May yield limited improvements but lack long-term sustainability and legal enforceability. Amending the Air Protection System (Preferred Option): Provides a comprehensive legal foundation compelling facilities to establish electronic linkage, thereby enhancing environmental oversight, transparency, and overall compliance levels. The analysis indicates that amending the system will yield significant benefits. These include enhanced environmental monitoring and improved air quality, reduced public healthcare costs, increased industrial competitiveness, attraction of responsible investments, and expansion of the environmental services market. Furthermore, it will advance environmental justice, protect biodiversity, and support Jordan's international commitments. Conversely, the private sector would bear an initial capital investment estimated at 10.2 million Jordanian Dinars to link 136 facilities, plus annual operational costs of approximately 765,000 Dinars. The government would incur costs related to developing the central monitoring system, upgrading technical infrastructure, and providing institutional training. Despite these costs, the study demonstrates that the long-term economic, health, and environmental returns significantly outweigh the costs of compliance. Therefore, amending the system is the most effective and sustainable option for protecting air quality and public well-being in Jordan.
